General Waiver & Release Form:

I hereby acknowledge:

• I know of no physical or medical conditions, which I feel could be worsen by using the equipment and facilities or participating in activities sponsored by KORE. Example not limited to (Heart conditions, joints and bones injuries, recent surgeries, Pre-& Post Natal). If so, consult your doctor before joining KORE. 
• I hereby understand and acknowledge that the training programs and events held by KORE may expose me to risks, including accidents & injury.
• I hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in an activity.
• I am aware that this is a waiver and release and I voluntarily agree to its terms.

Terms & Conditions:

1. PROVISIONS. KORE will provide a fully equipped exercise facility. KOREs facilities may be unavailable during a period of repair and maintenance or special events. In order to keep the facility in the best possible condition a portion of KORE may be closed for a temporary time period for repairs and renovations. There will be no adjustment in dues for this period of closure.

2. MEMBER’S HEALTH WARRANTY. The member warrants and represents that the member or any family member or guest entitled to use the facilities of KORE under the terms of membership, has no disability, impairment, or ailment preventing him/her from engaging in active or passive exercise, or that will be detrimental or adverse to such person’s health, safety, or physical condition if he/she does so engage or participate. The Member acknowledges and agrees that: 1) KORE will rely on the foregoing warranty in issuing the Membership; 2) KORE shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition; 3) if any fitness assessment or similar testing is performed by KORE, it is solely for the purpose of providing comparative data with which the Member can track progress in a program and is not for diagnostic purposes. 4)  KORE shall not be subject to any claim, demand, or injury whatsoever on account of the KORE’s evaluation or interpretation of such fitness assessment or similar testing. 5) KORE shall not be liable for any injury arising out of the member’s disability impairment or ailment preventing him/her from engaging in active or passive exercise, or that would be detrimental or adverse to such person’s health, safety or physical condition if he/she does so engage or participate. Each member and guest should be aware of his/her medical history and should consult with a physician prior to engaging in exercise or continuing to exercise if a medical condition appears or appears to be developing.

3. LIABILITY AND WAIVER OF LIABILITY. Each member of KORE shall be liable for any property damage and/or personal injury (caused by the Member, Member’s Family, Guest or any other person) at KORE. It shall be the obligation of the member to pay for any costs involved upon presentation of a statement thereof. Any and all use of KORE, or participation in, KORE, activities operated, arranged or sponsored by KORE either on or off of KORE’s premises by the Member, Member’s Family or Guest(s) shall be AT SUCH PERSON’S OWN RISK, and KORE shall not be liable for any injuries or damages to such person, or the property of such person, or be subject to any claim, demand, injury or damages.

4. SUSPENSION/TERMINATION OF MEMBERSHIP BY MANAGEMENT. Management has the right to suspend and/or terminate any membership for non-payment of dues, fees, or for behavior inimical to the enjoyment of KORE by other members and staff for any reason deemed sufficient in the sole discretion of Management.

5.     BUYER’S RIGHT TO CANCEL OR TERMINATE OR FREEZE:

5.1 – Yearly Subscription Members: 

• All Cancellation must be in writing and delivered to KORE in person.
• If cancelled, the deposit will not be returned back to the member.
• All paid amounts are non refundable
• All members must pay all current charges prior to termination.

5.2 – Memberships: All Prepaid memberships are non-refundable nor cancellable non transferrable.

5.3 – PT and class packages: All PT and class packages are non-refundable nor cancellable non transferrable.

5.4 – Freezing: Members have the right to freeze their subscription, PT and class packages prior to expiry in increments of 7 days (7, 14, 21, 28). Freezing periods depend on type of service.

5.5 – Cancelation of booking: KORE’s cancellation / No show policy as shown below:

• 12-hour cancellation policy for all group classes.
• 24-hour cancellation policy for all private training sessions.
• If you cancel less then 12 hours before your scheduled class time it is considered a Late Cancel, if you fail to show up it will be considered a No Show. Class package holders will lose one class from their package. Membership holders will be charged a late cancellation fee of SAR 50 which will go to a charity chosen by KORE.
• Late Cancellation 3 times in the same month will result in online booking being deactivated.
• No show policies: Any member/nonmember failing to attend a class for which they have booked will not be able to book on the same class the following week.
• Cancellations accepted by phone, email, iPhone app or online.

6. UNPAID BALANCES. All balances which are 30 days past due are subject to a 100 SAR monthly service fee. In addition to other rights, Management reserves the right to:

1. Collect the current and past due balance.
2. Suspend and/or terminate membership privileges.
3. Recover from Member(s) any collection fees, court costs, and reasonable attorney’s fees agreed to be 30% of the entire balance due and owing.

7. AGREEMENT AND RELEASE OF LIABILITY. KORE will provide access to the building using an access point system. I acknowledge that supervision is not always provided at the facility. I acknowledge that use of the RFID/Barcode system by someone other than myself will result in loss of membership.

8. ENTIRE AGREEMENT. This agreement and bylaws constitute the entire and exclusive membership agreement between the parties. Any promise, representation, understanding, oral or written, pertaining directly or indirectly to the agreement which are not continued herein, are hereby waived.

9.  I/We (Member) hereby authorize KORE to effect payment for monthly dues and approved membership charges for the duration of my/our membership through electronic funds transfer. This authorization is to remain in full effect until expiration of membership.

10.  I/We hereby agree to accept and abide by the terms of this Membership Application and Agreement. I/We understand that this membership agreement is for the term stated on the sale and will continue thereafter until expiration.

I certify that I have received a copy of the Rules and Bylaws and have read and understand them.

 نموذج تنازل واخلاء طرف:

بقراءة التالي انا اقر أنني: 

• لا اعاني من أي مشاكل صحية مثل (مشاكل فالقلب او المفاصل او العظام، جراحة في وقت سابق، حامل أو ولادة في وقت قريب) والتي قد تسوء باستخدام الأجهزة أو المشاركة في نشاطات كور، في حالة تطابق ما سبق الرجاء استشارة الطبيب قبل الانضمام.
• بهذا أنا أقر وأفهم بأن برامج التدريب التي تقيمها كور قد تعرضني لمخاطر مثل الإصابات والحوادث.
• بهذا أقر بمسؤوليتي بإعلام كور بأي مشاكل صحية أو إصابات قد تحدث في المستقبل وقد تتعارض مع مشاركتي في النشاطات.
• أنا أقر بمعرفتي ب نموذج التنازل وإخلاء الطرف وأقر بموافقتي على شروطه.

الشروط والاحكام:

١- يوفر كور منشأة مجهزة متكاملة ولكن قد تغلق خلال فترات معينة لعمل إصلاحات أو تطوير المكان أو خلال مناسبات خاصة للحرص على بقاء هذه المنشأة في أفضل حالة ممكنة، سيكون هناك تعديل للمستحقات خلال هذه الفترة. (ملاحظة: إغلاق أيام الإجازات الرسمية من قبل الحكومة لا يوجد لها تعويض)

٢– تأمين سلامة المشتركين و بالتالي:

١) يضمن ويقر المشترك له ولضيفه أو احد أفراد عائلته استخدام منشأة كور ضمن أحكام العضوية بأنهم لا يعانون من أي مشاكل صحية أو إعاقات قد تمنعهم من الانخراط في النشاطات أو قد تعرضهم للإصابة.

٢)- كور غير ملزم بعمل تقييم جسدي أو اختبار الحالة الجسدية للمشتركة.

٣)-  اذا وجد أي استشارة سيكون بغرض بحت للمقارنة و لتطورالعميلة في البرنامج الرياضي وليس لأغراض أخرى.

٤)- كور لن يخضع لأي مطالب أو ادعاء أو إصابة أياً كانت على حساب التقييم للاستشارة والاختبار الشخصي.

٥)- كور غير مسؤول عن أي إصابة قد تحدث مستقبلاَ بسبب أي إعاقة قد تمنعها من المشاركة في الأنشطة أو التمارين التي قد تسبب الأذى لصحتها إذا كانت مشاركة، يجب على كل عضوة أو ضيفة أن تكون على وعي بتاريخ حالتها الصحية ويجب أن تستشير طبيب قبل بدء التمارين أو إكمال التمارين في حالة ظهور أي عارض صحي.

٣– نموذج المسؤولية:

يتحمل كل عضو من أعضاء كور مسؤولية إتلاف الممتلكات التي يسببها (العضو أو أحد أعضاء عائلته، ضيفه أو أي شخص آخر) وسيكون ملزم بدفع قيمة التعويض. يتحمل المشترك مسؤولية نفسه وضيفه أو فرد عائلته الشخصية عند استخدام أو الانخراط في النشاطات التي تقيمها كور سواء في المنشأة أو خارجها ولن يتحمل كور أي أصابه أو مكروه يحدث للشخص أو ممتلكاته ولن يخضع لأي ادعاء أو محاسبة بهذا الشأن. 

٤– إيقاف أو انهاء الاشتراك من قبل الإدارة:

يحق لإدارة كور إنهاء أو إيقاف اشتراك العضوة لعدم دفع المبالغ المستحقة أو سلوك غير أخلاقي مسيء لكور أو احد موظفيه او عملائه لأي سبب تراه الإدارة كافيا.

٥. حق المشترك لأنهاء أو إلغاء أو تجميد الاشتراك:

1–الاشتراكات: جميع الاشتراكات غير قابلة للاسترجاع او الإلغاء أو التحويل.

2– التدريب الشخصي وباقة الحصص: جميع باقات الحصص والتدريب الشخصي غير قابلة للاسترجاع او الإلغاء.

3– التجميد: لدى العميل الحق لتجميد الاشتراك بمضاعفات السبعة أيام و فقط قبل مدة الانتهاء (٧،١٤،٢١،٢٨) يعتمد مدة التجميد على حسب نوع الاشتراك.

4– الحجز أو الإلغاء: التالي سياسة كور للإلغاءات و عدم الحضور:

• الإلغاء قبل ١٢ ساعة من موعد الصف.
• الإلغاء قبل ٢٤ ساعة من موعد التدريب الشخصي.
• عند الإلغاء خلال اقل من ١٢ ساعة قبل موعد الكلاس سيحسب كإلغاء متأخر وسيتم خصم صف واحد من باقة الصفوف سيكون مسؤول لدفع ٥٠ ريال والتي ستحول لجمعيات خيرية من اختيار كور.
• عند حدوث ٣ إلغاءات متأخرة سيتم حجب خدمة حجز الصفوف عن طريق التطبيق.
• عند عدم الحضور في حاله الحجز للمشتركة أو غير المشتركة سيتم حجب خدمه الحجز لنفس الصف في الأسبوع التالي.
• يتم قبول طلب إلغاء الصف عند الاتصال الهاتفي أو البريد الالكتروني أو التطبيق الهاتفي.

5–الرصيد الغير مدفوع : عند التخلف عن الدفع لمده ٣٠ يوم سيتم إضافة ١٠٠ ريال كرسوم خدمة شهرية، بالإضافة إلى عدة حقوق أخرى للإدارة:

• تحصيل الرصيد المستحق السابق أو الحالي.
• إيقاف أو إنهاء الاشتراك.
• سيتم الاسترداد من الأعضاء أي رسوم تحصيل، وتكاليف المحكمة، وأتعاب المحاماة على أن تكون 30٪ من كامل الرصيد المستحق والمطلوب.

6– الموافقة و اخلاء المسؤولية: سيوفر كور إمكانية استخدام المرافق من خلال استخدام نظام نقطة الوصول، مع العلم بأن لا يوجد شخص يشرف على المنشأة طوال الوقت وأنا الوحيدة المسموح لها استخدام الباركود الخاص باشتراكي وعند سماحي لشخص آخر باستخدامه سيتم إنهاء عضويتي

7- الاتفاقية. وتشكل هذه الاتفاقية واللوائح اتفاقية العضوية الكاملة والحصرية بين الطرفين. يتم التنازل عن أي وعد أو تمثيل أو فهم شفوي أو مكتوب، بشكل مباشر أو غير مباشر بالاتفاقية التي لم تتم مواصلتها هنا.

8- بموجب هذا أنا العضو أئذن لكور لدفع المدفوعات للمستحقات الشهرية ورسوم العضوية المعتمدة طوال مدة عضويتي من خلال تحويل الأموال الإلكترونية. ويبقى هذا الإذن مخول بالكامل حتى انتهاء العضوية.

9– بهذا أنا أقر وألتزم بشروط العضوية، وسيبقى هذا الاتفاق لمدة الاشتراك

أقر بأنني تلقيت نسخة من القواعد واللوائح الداخلية وو أنه تمت قرائتها وفهمها.
